Terms and Conditions
Optimum7 Skills
These Terms and Conditions (the “Terms”) are a binding agreement between you (“you” or the “User”) and Optimum7 LLC (“Optimum7,” “we,” “us,” or “our”), governing your use of the Service described below. By creating an account, installing the Desktop Application, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
1. Acceptance of These Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and to our handling of data as described in Section 10. If you do not agree, you must not access or use the Service. We may require you to re-accept these Terms when we make material changes (see Section 17).
2. Definitions
- “Service” means, collectively, the Optimum7 Skills web application (the “Platform”), the authoring tools, the application programming interfaces, and the Desktop Application.
- “Platform” means the browser-accessible web application used to create, manage, version, and grant access to Skills.
- “Desktop Application” means the Optimum7 Skills synchronization client for macOS and Windows that you install on your computer.
- “Skills” and “Plugins” mean the packaged units of automation, instructions, and associated files distributed through the Service.
- “Organization” means the company or team account to which a User belongs and under which access to Skills is granted.
- “Content” means any data, text, files, prompts, or materials you submit to or create with the Service.
3. Accounts & Eligibility
Access to the Service requires an account. Authentication is performed through Google single sign-on (Google OAuth). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old and capable of forming a binding contract to use the Service.
The Service uses an organization and role model. Administrators of an Organization may create accounts, assign roles, grant or revoke access to specific Skills, and manage shared resources such as API keys. You acknowledge that your Organization’s administrators control your access and may add, modify, or remove your entitlements at any time.
4. The Service
The Service enables your Organization to:
- create and edit Skills through a guided, AI-assisted authoring workflow (“Forge”), or by uploading Skills built elsewhere;
- version and publish Skills to a central library, with a full audit history and the ability to roll back;
- control, per person or per team, who may view and who may run each Skill;
- distribute entitled Skills automatically to Users’ computers through the Desktop Application; and
- route certain third-party data-provider requests through a managed server-side proxy so that shared API keys remain centralized and scoped.
We may add, change, suspend, or discontinue features of the Service at any time. We will use commercially reasonable efforts to provide the Service but do not guarantee uninterrupted or error-free operation.
5. The Desktop Application
The Desktop Application is a lightweight synchronization client that runs on your computer and keeps your entitled Skills up to date. By installing and running it, you authorize it to perform the operations described in this Section. This Section is important — please read it in full.
5.1 What it installs and where
The Desktop Application downloads Skills and Plugins to which your account is entitled and installs them into the Claude Code configuration directory located within your user home folder (specifically, the ~/.claude/skills directory). It writes, updates, and removes files and folders within that directory as part of normal synchronization. It is scoped to its own working directory and the Claude Code configuration directory; it is not designed to access, read, or modify your unrelated personal files.
5.2 Background synchronization
After you sign in, the Desktop Application runs in the background (including from the system tray) and periodically — approximately every fifteen minutes — connects to our servers to check for changes. When a new or updated Skill is available, it downloads and installs it automatically. When your access to a Skill is revoked, or you are removed from a team, the Desktop Application removes that Skill from your computer on the next synchronization. You consent to this automatic installation, updating, and removal of Skills.
5.3 Integrity verification
Downloaded packages are delivered over secure connections and verified against a cryptographic checksum (SHA-256) before installation, and installation is performed atomically to avoid partially written files.
5.4 Credentials and device registration
To stay signed in, the Desktop Application stores an authentication token on your device. Where your operating system provides secure credential storage (the macOS Keychain or the Windows Data Protection API), the token is stored using that facility. The first time it synchronizes, the Desktop Application registers your device with our servers and reports basic device information, including your computer’s hostname and operating-system platform, together with a generated device identifier. See Section 10 for details.
5.5 Usage telemetry hooks
To help your Organization understand which Skills are used, the Desktop Application installs a small usage-tracking hook into your Claude Code settings file (~/.claude/settings.json), keeping a one-time backup of that file before modifying it. The hook records when an entitled Skill is invoked. The data collected is limited as described in Section 10. When you sign out, the Desktop Application removes the hook and deletes the associated local telemetry files.
5.6 What the Desktop Application does not do
The Desktop Application does not itself execute Skill code. Skills are installed as files and are invoked by your separately installed Claude Code environment, which operates under its own terms. The Desktop Application does not collect the contents of your Skills, your prompts, or files outside its scope. Removing the Desktop Application stops synchronization; previously installed Skill files may remain on your computer until deleted. Signing out before uninstalling performs a fuller cleanup.
6. License & Restrictions
Subject to these Terms, Optimum7 grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Desktop Application and to access and use the Skills to which you are entitled, solely for your internal business purposes.
You may not, and may not permit others to:
- copy, redistribute, sublicense, sell, rent, or otherwise make the Service or any Skill available to anyone outside your authorized use;
- reverse engineer, decompile, or disassemble any part of the Service, except to the extent that restriction is prohibited by applicable law;
- circumvent, disable, or interfere with access controls, integrity checks, usage metering, or other security or licensing features;
- use the Service to build a competing product or to extract our proprietary content; or
- remove or alter any proprietary notices.
7. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation;
- infringe the intellectual property, privacy, or other rights of others;
- transmit malware or attempt to gain unauthorized access to any system, account, or data;
- disrupt or impose an unreasonable load on the Service or its infrastructure; or
- create or distribute Skills that perform unlawful, harmful, or deceptive actions.
8. Intellectual Property
The Service, including its software, design, and the Skills and content made available through it (other than your Content), is the property of Optimum7 or its licensors and is protected by intellectual-property laws. Skills published within your Organization are confidential and proprietary, and you may use them only as permitted by your entitlements.
You retain ownership of Content you create. You grant Optimum7 a worldwide, non-exclusive license to host, store, process, and display your Content as necessary to operate and provide the Service. You are responsible for ensuring you have the rights to any Content you submit.
9. Third-Party Services
The Service relies on third-party providers, which may include Anthropic (Claude models), Supabase (authentication and database), Google (single sign-on), Railway (hosting), sandboxed code-execution environments used during authoring, and third-party data providers invoked by certain Skills. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services, and their availability or behavior is outside our control.
10. Data, Telemetry & Privacy
This Section describes the data we collect through the Service and the Desktop Application, how we use it, and what we do not collect. By using the Service, you consent to this processing.
10.1 Information we collect
- Account information. When you sign in with Google, we receive your name, email address, and basic profile information associated with your account, and we maintain your Organization and role assignments.
- Device registration information. The Desktop Application reports your computer’s hostname, operating-system platform, and a generated device identifier so that your Organization can see which devices are synchronized and up to date.
- Usage telemetry. When you invoke an entitled Skill, the Desktop Application records an event consisting of the Skill’s identifier (its slug), a timestamp, the version, and the name of the agent environment (for example, “claude-code”). These events are queued locally and sent to our servers in batches. Telemetry hooks are currently active on supported operating systems
- Authentication tokens. Tokens used to keep you signed in are stored on your device as described in Section 5.4.
- Operational logs. We collect standard server logs and error information necessary to operate and secure the Service.
10.2 What we do not collect
We do not collect the contents of your Skills, the prompts you write, the outputs Skills produce, or files on your computer outside the Desktop Application’s scope. Usage telemetry records that a Skill was invoked — not what you did with it.
10.3 How we use data
We use the data described above to operate, secure, and improve the Service; to distribute Skills and enforce access controls; to give your Organization visibility into device synchronization and Skill usage; and to comply with legal obligations.
10.4 Sharing, retention, and security
We share data with the sub-processors described in Section 9 to the extent necessary to provide the Service, and as required by law. We retain data for as long as your account is active or as needed to provide the Service and meet legal requirements, and we apply commercially reasonable technical and organizational measures to protect it. We do not sell your personal information.
11. Fees & Subscriptions
The Service may be offered free of charge to authorized Users or under a paid subscription. Where fees apply, they will be presented to you before purchase, are payable in advance, and are non-refundable except as required by law or expressly stated at the time of purchase. We may change pricing on a prospective basis with reasonable notice.
12. AI-Generated Output
Skills use artificial-intelligence models to generate output. Such output may be inaccurate, incomplete, or otherwise unsuitable for a particular purpose, and may vary between runs. You are responsible for reviewing and validating any output before relying on it. You must not use the Service or any Skill as a substitute for professional advice where such advice is appropriate.
13. Disclaimer of Warranties
THE SERVICE, THE DESKTOP APPLICATION, AND ALL SKILLS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. OPTIMUM7 DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMUM7 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OPTIMUM7’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO OPTIMUM7 FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless Optimum7 and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your Content, or your violation of these Terms or applicable law.
16. Term & Termination
These Terms apply while you use the Service. You may stop using the Service at any time. We or your Organization’s administrators may suspend or terminate your access at any time, with or without cause. Upon termination of your access to a Skill or to the Service, your entitlements end and the Desktop Application will remove the affected Skills from your computer on the next synchronization. Sections that by their nature should survive termination (including Sections 8, 13, 14, 15, 18, 19, and 20) will survive.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
18. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to Section 19, you and Optimum7 agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
19. Dispute Resolution
The parties will attempt in good faith to resolve any dispute informally before initiating formal proceedings. TO THE EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY AND AGREES THAT ANY DISPUTE WILL BE BROUGHT ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Any claim must be brought within six (6) month after it arises, to the extent permitted by law.
20. General
These Terms, together with any terms referenced herein, constitute the entire agreement between you and Optimum7 regarding the Service and supersede all prior agreements on that subject. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. Notices to you may be provided through the Service or by email; notices to us must be sent to the contact address below.
